Businesses intending to sell tobacco, non-tobacco smoking products and/or e-cigarettes must notify NSW Health before commencing such activities. Failure to notify NSW Health about tobacco and e-cigarette retailing activities is an offence. NSW Health Authorised Inspectors can issue on-the-spot fines of $360.
Tobacco and e-cigarette retailers must also notify NSW Health within 28 days after becoming aware of changes to:
- the business address;
- the trading premises address;
- the name or address of any owner of director of the business; or
- a change in the ownership of the business
